Terms of Service

Acceptance of Terms

By accessing or using the websites and services of the Neon Law Foundation and of Neon Law — a service of Shook Law PLLC — (together, "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

Who Provides These Services

Two organizations operate through this site:

No Legal Advice Without Engagement

Information on this website is for general informational and educational purposes only and does not constitute legal advice. An attorney-client relationship is formed only upon execution of a written engagement agreement with Shook Law PLLC. Where these Terms refer to legal representation, that representation is provided by Shook Law PLLC; the Foundation does not practice law.

Conflicts of Interest

One firm, one conflicts check. We are a small firm and we run conflicts across the whole firm: if taking your matter would conflict with any current or former client of any of our attorneys, we will tell you and decline the matter rather than screen it internally. To do this, our attorneys share incoming-matter information with one another. Contacting us does not create an attorney–client relationship, and we keep what you send us confidential whether or not we end up representing you.

Use of Services

Our programs and resources are intended for lawful purposes consistent with the Foundation's mission and the firm's professional obligations. You agree not to misuse any information or services provided, and to provide accurate information when requesting legal assistance.

Trademarks

NEON LAW is a registered trademark of Shook Law PLLC (U.S. Reg. No. 6,325,650). The Neon Law name, logo, and related marks remain the exclusive property of their owner. Any use of the NEON LAW trademark without our prior written permission is unauthorized.

Limitation of Liability and Hold Harmless

Use of this site and our services is at your sole risk. We make commercially reasonable efforts to deliver our programs and to safeguard the information you provide, but we make no warranty, express or implied, regarding outcome, availability, or freedom from defect or compromise.

To the maximum extent permitted by law, you release, indemnify, and hold harmless the Neon Law Foundation, Shook Law PLLC (doing business as Neon Law), and their respective officers, employees, attorneys, contractors, agents, and volunteers from any claim, loss, liability, or expense — direct, indirect, incidental, consequential, or punitive — arising from your use of the services, excepting only our gross negligence or willful misconduct.

Our aggregate liability, if any, is capped at the lesser of fees you paid us in the preceding twelve months or one hundred United States dollars. This limitation survives termination.

Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or your use of our services will be resolved exclusively in the state or federal courts located in Washoe County, Nevada, and you consent to the jurisdiction of those courts.
